Official Rules

Eligibility: This Jet Across the Pond Prize Draw Presented by Charles Tyrwhitt (“Prize Draw”) is open only to individuals who are permanent legal residents of the United Kingdom, 18 years of age or older at the time/date of entry. Void outside the United Kingdom and where prohibited by law. Employees, officers, directors, agents and representatives of New York Jets LLC (hereafter, “Sponsor”), Charles Tyrwhitt Shirts Limited, the National Football League, its member professional football clubs, NFL Ventures, L.P., and each of their respective parents, affiliates, subsidiaries, wholesalers, retailers, distributors, suppliers, advertising & promotion agencies (hereafter collectively, “Released Parties”), and each such individual’s immediate family members (mother, father, sister, brother, child, husband, wife & their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win. All applicable laws apply.

Promotion Period: Prize Draw starts 2:00:01 am Greenwich Mean Time (“GMT”) on 30 October 2022 and ends at 11:59:59 pm GMT on 22 November 2022 (hereafter, “Promotion Period”).

How to Participate: Visit NYJetsinUK.com during the Promotion Period and follow the instructions provided to complete and submit the Official Entry Form to receive one (1) entry. All entries must be received by 11:59:59 pm GMT on 22 November 2022 to be eligible. Limit one (1) entry per person, per email address and per household throughout the Promotion Period. You may only use one (1) email address to enter the Sweepstakes. Entries received from any person, email address, or household in excess of the above stated limitation will be void. Your submission of an entry constitutes your consent to participate in this Sweepstakes and your consent for Sponsor to obtain, use and transfer your name, address and other information for the purpose of administering this Sweepstakes. The use of script, macro or automated devices (or any other devices intended to automate or subvert any aspect of entry) to enter the Sweepstakes is prohibited and any entry through such means and any entry that is deemed to be ineligible (at Sponsor’s sole discretion and in accordance with these Official Rules) will be void. All entries become the exclusive property of the Sponsor and will not be acknowledged or returned. In the event of a dispute as to the identity of an entrant based on the email address submitted, entry will be awarded to the person named on the applicable Official Entry Form (regardless of whether that is the name of the authorized account holder of the email address from which said entry form was submitted) provided such individual is eligible according to these Official Rules.

Winner Selection: Potential winner will be selected in a random drawing conducted on or about 23 November 2022 from among all eligible entries received during the Promotion Period. Drawing will be conducted by Sponsor. Each valid entry will have an equal chance of winning. Odds of winning will depend upon the total number of eligible entries received. Potential winner will be required to execute and return an Declaration of Eligibility, Liability and (where legal) Publicity Release as well as any other documents required by Sponsor within twenty-four (24) hours of time/date of issuance of notification. Winner’s guest must be at least eighteen (18) years of age and must execute and return a Liability/Publicity Release prior to travel. Noncompliance with any of the foregoing, failure to respond within the designated timeframe, the inability to contact the potential winner within a reasonable time period, or any notification being returned as undeliverable may result in disqualification and, at Sponsor’s discretion and time permitting, an alternate winner being selected. Winner status is subject to verification of eligibility and compliance with these Official Rules. The Released Parties are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in the potential winner’s email account to receive email messages.

One (1) Grand Prize: Grand Prize includes a 4-night trip for winner and one (1) guest to attend the New York Jets home football game currently scheduled to take place at MetLife Stadium on 18 December 2022 (hereafter “Trip”). Trip consists of round-trip coach air transportation from major airport nearest to winner’s primary residence in the UK to the US, standard double-occupancy hotel accommodations for four (4) nights, two (2) tickets to the New York Jets game with pre-game field access, ground transportation to/from hotel and MetLife Stadium, two (2) $500USD Charles Tyrwhitt gift cards to use during a personal stylist appointment (while on Trip) at the Charles Tyrwhitt store located in NYC and assorted New York Jets merchandise. Approximate Retail Value (“ARV”) = $7,250 GBP. Travel and hotel arrangements determined by Sponsor in its sole discretion and must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. Trip must be taken between 15 December 2022 and 19 December 2022 or prize will be forfeited in its entirety and may be awarded to an alternate winner, in Sponsor’s sole discretion. Winner and guest must travel together on the same itinerary. Winner and guest are responsible for obtaining all necessary travel documents and passports prior to booking Trip. Participation in the Trip is subject to winner’s (and guest’s) consent to and compliance with all health and safety policies currently in effect at the time of travel, including but not limited to the wearing of masks if and when directed and any requirement to be vaccinated against COVID-19. If the Trip is canceled or postponed for any reason by the Sponsor, the Sponsor will substitute the prize with something of comparable value. All prize details are at Sponsor’s sole discretion. Certain travel restrictions may apply. Unless otherwise indicated herein, all expenses and travel costs including, but not limited to, all transportation, parking, meals, incidental, surcharges, service charge or facility charges, personal charges at hotel, taxes or other expense, of the Grand Prize are the responsibility of winner and his/her guest. All elements of the Grand Prize are subject to availability, blackout days and other restrictions. All elements of the Grand Prize must be used during the same stay. The Grand Prize winner will be required to present a major valid credit card at the time of check-in to cover incidentals and fees/services not include in the prize. Actual value of prize may vary based on time of stay, flights and other factors. No changes may be made by Grand Prize winner (or winner’s guest) to prize details once any portion of arrangements has been made. Sponsor is not responsible for changes in schedule of any element of the prize. PRIZE IS AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED.

Privacy: Any information entrant provides to Sponsor may be used to communicate with entrant in relation to this Sweepstakes or on a Sweepstakes winner’s list. Except where prohibited by law, acceptance of a prize constitutes winner’s irrevocable permission for Released Parties, each of their respective agents, successors and assigns or other designees to use winner’s name, likeness, photograph, voice, statement, opinions, username, social profile, biographical information, prize and/or region/city of residence for advertising and promotional and publicity purposes in any and all media or format, worldwide, in perpetuity, without any permission, notification, payment or consideration, except for the awarding of the prize to the winner.

Miscellaneous: No transfer, assignment, cash redemption or substitution of a prize (or portion thereof) will be permitted, except by Sponsor, in its sole discretion, due to prize unavailability or other causes otherwise determined solely by Sponsor, and then for a prize (or applicable portion) of equal or greater value. If any prize or prize notification letter is returned as undeliverable or the prize is declined for any reason, potential winner will be disqualified and, at Sponsor’s sole discretion and time permitting, an alternate winner may be selected by random drawing from all entries received. Should a potential winner decide to decline his/her prize for any reason whatsoever or not respond to the prize notification by the applicable response deadline, Sponsor shall have no further obligation to that potential winner and an alternate winner may be randomly selected from among all remaining eligible Prize Draw entries, if time permits. The Released Parties are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s email account to receive email messages. By participating, entrants agree to be bound by these Official Rules and agree that Released Parties and their designees and assigns and all of their respective officers, directors, employees, shareholders, representatives, agents, and the franchisees of any of them shall have no liability and entrant will defend, indemnify and hold harmless the Released Parties from and against any liability, loss, injury, or damage of any kind (including attorney’s fees) to any person or entity, including, without limitation, personal injury, death or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of: (i) entrant’s participation/entry into the Prize Draw; (ii) any materials he or she may submit in connection herewith; or (iii) the acceptance, possession, use or misuse of a prize or participation in any activities associated with the Prize Draw or any prize awarded in connection herewith; (iv) the Released Parties’ violation of rights of publicity or privacy, claims of defamation or portrayal in a false light or based on any claim of infringement of intellectual property; and (v) any typographical, human or other error in the printing, offering, selection, operation or announcement of any Prize Draw activity and/or prize. Notwithstanding anything elsewhere in these Official Rules, no person’s or entity’s liability for death or personal injury caused by its negligence shall be limited in any way, and nor shall their liability for fraud or for any other matter where liability may not as a matter of law be limited or excluded. The Released Parties are not responsible for the actions of entrants in connection with the Prize Draw, including entrants’ attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Prize Draw. Sponsor reserves the right, in its sole discretion, to void any and all entries of an entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness, or proper play of this Prize Draw and to modify, suspend, and/or terminate this Prize Draw (or portion thereof) should virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Prize Draw and, in the case of termination, at its discretion, select winner via a random drawing from all eligible, non-suspect entries received prior to the event that required such termination. In the event Sponsor is prevented from continuing with the Prize Draw by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Prize Draw by any party, or any federal, provincial or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure Event”), Sponsor shall have the right to modify, suspend or terminate the Prize Draw or prize. Sponsor additionally reserve the right, in their sole and absolute discretion: (a) to modify, suspend or terminate the Prize Draw should causes beyond Sponsor’s control corrupt or interfere with the administration, integrity, operation, security or proper play of the Prize Draw; or (b) to disqualify any entrant found to be, or suspected of: (i) tampering with the entry process or the operation of the Prize Draw; (ii) acting in violation of these Official Rules; or (iii) acting in an un-sportsmanlike manner. Wherever these Official Rules provide for discretion exercisable by a Released Party that could otherwise be capable of causing a significant imbalance in the parties’ rights and obligations under these Official Rules, to the detriment of a consumer and contrary to the requirement of good faith, that discretion shall be exercised reasonably and in good faith. CAUTION: Any attempt to undermine the legitimate operation of this Prize Draw may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor and the applicable Released Parties reserve the right to seek damages (including attorneys’ fees) and/or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law. Released Parties make no warranty, guaranty or representation of any kind concerning any prize (or any portion thereof), and disclaim any implied warranty. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Prize Draw, shall be governed by, and construed in accordance with, the laws of England, without regard to any other conflicts of law principles. All entrants consent to the jurisdiction and venue of the county and municipal courts of England. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Prize Draw-related materials, and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.

The winner’s surname and county where applicable will be available until 31 January 2023. If you object to any or all of your surname, county and winning entry being published or made available, please contact Ben Carter at ben.carter@sportfive.com. In such circumstances, Sponsor must still provide the information and winning entry to the Advertising Standards Authority on request.)
